 What is Sexual Assault and Punishment for Sexual Assault under POCSO Act 2012

1) Introduction – 

     This Act was enacted in the year 2012 and came into force within the territory of India. This Act is enacted to protect children from offenses of sexual assault, sexual harassment, and pornography and provide for the establishment of Special Court for trial of such offenses.  Section 7 of The Protection of Children from Sexual Offenses Act, 2012 defines Sexual assault.  Section 8 of the said Act provides punishment for sexual assault.

2) What is Sexual Assault – 

        According to Section 7 of the Protection of Children from Sexual Offences Act 2012 whoever, with sexual intent, touches the vagina, penis, anus or breast of the child or makes the child touch the vagina, penis, anus or breast of such person or any other person, or does any other act with sexual intent which involves physical contact without penetration is said to commit sexual assault.

3) Punishment for Sexual Assault under POCSO Act 2012

        Section 8 of this Act provides Punishment for sexual assault,  according to Section 8 of the POCSO Act, 2012, whoever, commits sexual assault, shall be punished with imprisonment of either description for a term which shall not be less than three years but which may extend to five years, and shall also be liable to fine.Conclusion – 

    The protection of children from sexual assault is very important.  The government of India enacted the Protection of Children from Sexual Offences Act, 2012. Section 7 of the protection of children from sexual offenses Act, 2012 defines  Sexual assault and Section 8 of the said act provides punishment for such act.
